To claim death benefits for Gratuity without written proof, you should follow the procedures outlined by the company's HR department. Typically, in such situations, the HR department may require alternative documentation to support the claim, such as a death certificate, proof of relationship to the deceased, and any other relevant information. It is essential to communicate with the HR department promptly and provide any available evidence to support the claim. This will help expedite the processing of the death claim and ensure that you receive the Gratuity benefits entitled to you. If you are unsure about the specific requirements or procedures, do not hesitate to reach out to the HR department for guidance and assistance.

Hi,

The nominee of the deceased employee has to apply for Gratuity with the Employer with proof that he/she is the nominee.

Employer, if covered under a Group Gratuity scheme, can make payment through LIC or wherever covered. If not, it is the responsibility of the Employer to release the Gratuity payment.

If the poster is the nominee, he can approach the employer with necessary proof for identification and claim the gratuity amount for the deceased employee.

In the absence of nomination, he has to make the claim with a legal heir certificate issued by the Revenue Department. In case of multiplicity of claims by more than one legal heir, the employer will deposit the amount with the Controlling Authority under the Payment of Gratuity Act, 1972 for disbursement after an enquiry.
