Suspension pending enquiry - suspension allowance and refused my resignation. Can I join a new company?

The company suspended me for more than one month but only informed me that they are appointed an enquiry officer but I have not received any such from them. They provided me with a suspension allowance and refused my resignation. Can I join a new company?

Sudip, you cannot resign at any stage of the pending charges against you.
