Legal actions against breach of contract for employee hiring.

Hi,
If there is contract agreement between 2 organizations regarding non hiring of employee from other organization. Unintentionally 1 organization hire an employee from another organization due to non awareness of contract agreement signed off by Technical team. Is the organization will take legal action against another organization?

The agreement may not even be legal in India.
