Filed a case against my former employer - In how many days a case is dismissed if papers not filed?

Sir, I have filed a case against my former employer, and the same is in court since last year. However, I did not go to file papers on the first hearing as I was financially on the back foot. I received one more date but did not go, and since last year, no reminders have come. Can I assume the case has been dismissed? The employer says first close the case and show them proof, then they will settle dues.

I do not think the case filed by you got dismissed as no information received. But it cannot be ruled out that the case can be dismissed at any point in time on technical reasons. It is necessary on your part to file the papers related to the case as soon as possible. You should contact your lawyer to give you the present status of the case.

It is a good thing that your employer wants to settle your case in a mutually agreed-upon manner. Send a reply to the employer to have it in writing that they agree to settle the case on mutual understanding. Based on the said letter, you would be able to close the case. Be proactive before things move from your court to the employer's court.
