Statutory compliance of ESI due to dual employment issues - part-time night shift operator in another company

A person working in a company, whose salary is above 22000, is not covered by ESI. The same person joined on 1st Dec 2020 as a part-time night shift operator in another company with a 9k salary. Is he eligible for ESI? In the new night-shift job, they will bank transfer the salary to the same bank account that is used for the full-time job. When I asked for cash, they denied it. I need suggestions.

ESIC coverage is applicable to employees earning less than 21k salary. ESIC uses only one employee, one IP policy, so in this case, he will only be able to get registered at one employer only.

Dear Mahesh,

The employee can be insured under ESI where he is drawing a salary of Rs 9,000 because the ESI Act or any other Labor Law does not differentiate between a full-timer or a part-timer.
