Termination of Service during Covid 19 - compensation apart from his FNF considering his 12 years of service?

Hi,

Can a company terminate HR bench employees in the current COVID-19 situation? In a case where a 12.5-year tenure employee was on HR bench as his program got ramped down and was given verbal notice until 15 April, however, there is no official written communication on this. Now the company is asking him to submit his resignation... Please advise.

Can he claim some sort of compensation apart from his FNF considering his 12 years of service so that it will help him to survive until he gets a new job in the current situation of coronavirus? Thanks and Regards.

Obviously, he can ask for notice pay as per the contract of employment. If the notice period is three months, he should be paid three months' salary for early relieving or allowed to work for three months. Since it is a case of 'resignation' and not retrenchment, he cannot demand any retrenchment compensation as is paid to workmen category employees. Of course, he will get gratuity as per the law.

Thank you for your immediate response. However, in this case, the company is asking him to submit a resignation, and in return, assuring him of normal FNF as per the process.

Yes, when an employee is submitting his resignation by himself, he will be stating that "I may be relieved on a date which comes after three months/or one month," as the case may be. If so, asking the employee to leave immediately means he should receive three months' pay.
