A pharma company is similar to anyother company registered under the Companies Act, 2013 as an organic legal entity for general legal and common accounting purposes with the application of different labor laws depending on its unit wise activities. For example, its manufacturing facility would come under the Factories Act, 1948 and its registered/corporate office, if located separately would come under the respective State Shops and Establishments Act:so are the regional/branch offices or godowns. In the case of employment of medical representatives for the exclusive purpose of sales promotion operations, the Sales Promotion Employees Act would be applicable to such employees. Social security legislations like ESI, EPF, Gratuity, Maternity Benefit would be applicable taking the establishment as a whole. In addition, allied laws like the PW Act, 1936, MW Act etc and Industrial Relations Acts like the Standing Orders Act, 1946, the ID Act, 1947would also be applicable.
