Legal compliance requirement regarding a foreigner's visit to company's industrial premises in India

I need your valuable suggestion with respect to the Foreigner Act of 1946.

If any foreigners come to an industrial premises on a B-2 Visa for a business meeting, what would be the primary responsibilities of the employer? Would he be required to provide information regarding such a visit to the surrounding area jurisdiction? What is the legal compliance under the Foreigner Act of 1946?

Dear Seniors,

I need your advice on the aforementioned matter. Please provide me with information on Foreigner Act 1946 compliance for the company and outline the main responsibilities of HR in this regard.

Dear Gaurav,

Compliance is required for those who fall under the definition of workers as per applicable labor laws when employed in India. If someone is visiting for a meeting, they will not be considered a workman or employee and, therefore, there is no need for compliance under labor laws.

Dear Sir,

I am aware that foreigners are not covered under the provisions for workmen. However, when any foreigner enters the factory premises, we are required to notify the superintendent of police. I am inquiring about the employer's duties regarding foreigners. After gathering information from my HR friends, I have concluded that it is necessary for all employers.

Thank you.
