Date of resignation or Date of Relieving , which will be considered.

Dear sirs,

I submitted my resignation letter on 22.03.2018, stating that my last working day would be 31.03.2018. However, as of 13.04.2018, the Company has not issued me the relieving letter. Since the Company has not paid my March 2018 salary, I am still working at the same Company.

My question is whether my date of resignation is 31.03.2018 or if that is my last working day at the Company.

I would appreciate clarification on this matter.

Dear Prasad,

There is no mention about whether your resignation was accepted or not. Even after the effective date mentioned in your resignation, you are allowed to continue in the job, which implies that your resignation has not yet been accepted by your employer. In such a situation, your contract of employment comes to an end only on the date of relief consequent to the acceptance of your resignation. Please check whether you have complied with any notice clause in your appointment orders or service regulations of the organization.

Thank you for your valuable information. There is no specific notice period mentioned in the appointment letter which was issued to me on 10.10.2012. Now the management has been changed. Whenever an employee submits the resignation letter, the CEO replies stating that 'you have to serve three months notice'. After the submission of the resignation letter, we receive the notice period clause through email. I have an offer from another company in my hand. However, my CEO is not accepting my resignation and is convincing me to continue the services. Frankly, there is no future in the existing company. It is a routine policy here that those who resign will not receive their last month's salary. Till now, they have not paid the March month salary. After receiving the March month salary, I would like to request the CEO once again regarding the matter. If I request today or tomorrow, they may stop my March month salary. I will also incur a loss for the 15 days' salary from the 1st to the 15th of April 2018. Can I have your valuable suggestion, sir?
