Is it legal to take employee original marksheets and certificate as a job security?

SUFIAN1237
Dear All,

Our employer is requesting the submission of original documents. Is it legal to retain employees' original marksheets and certificates as a form of job security? Kindly provide your comments on this matter.

Thank you.

No.

It is unethical to withhold original certificates of candidates. The company can ask for the documents to verify them but not retain them as security.

If there is a written agreement between the employee and the employer to retain the certificate as security, then it can be labeled as legal.

Hi Sufian,

Generally, companies ask for original certificates from employees who handle cash. If this is not feasible, discuss it with your employer and convince them. It is not a legal requirement to collect originals from employees. These kinds of rules came into existence because some employees tend to deceive companies.

Thank you.

"Generally, companies ask for original certificates from employees who handle cash. Instead of our typical shortcuts, the company needs to secure fidelity bonds for such employees. Original educational certificates are the personal property of the employee, and it is incorrect to retain them as security."
