Company impossing wrong allegations to avoid October salary and F&F

Hi,

I was working as a Senior Merchandiser in an export house and resigned from my position on 07-November, serving a notice period of one month. However, on 17-November, I was unable to go to the office and informed my immediate senior (GM) about the situation. Subsequently, he instructed me not to come to the office from the following day, and I ceased attending.

I had been in contact with the factory manager regarding my October month salary, and he explained that the delay was due to a shortage of funds. Today, I have sent an email to the company's director regarding my payment. In response, I received an email from the GM containing the following false allegations:

1. Placing incorrect hardware orders with suppliers in China and India.
2. Providing inaccurate information to buying agencies about the in-house date of raw materials.
3. Failing to order the required quantity of hardware and raw materials.
4. Ordering the wrong finish for the hardware.
5. Not including thread and other reinforcement materials in the orders despite being questioned about it.
6. Failure to order packaging materials and misleading both the factory and the agency.
7. Purchasing local materials instead of ordering from the China supplier for SMS orders.
8. Buying hardware from MK in Sadar with cash, sending half for plating to Dinesh, and not receiving the rest.
9. Not ordering the correct color leather for SMS orders, leading to additional costs from another supplier.
10. Lying during internal meetings with agencies about order placements.
11. Keeping the GSP of a customer intentionally, resulting in losses for the company.

All the accusations made above are false, and I could have proven most of them wrong if I had access to my official ID. Unfortunately, I no longer have access to my official email account. The company's actions seem to be an attempt to defraud and harass me.

Please advise on how to proceed in this situation.

Reply politely declining any liability for errors in your work and request access to your email ID and records to verify your work.

Are you the sole person responsible for orders, or were there others in the organizational chain? Do you have the authority to decide what to order, or do you only order what the concerned departments request?

Was your resignation accepted by the company? Did your immediate senior provide you with written instructions not to report to the office the next day?

Consider consulting the labor officer in your area for advice on the next steps if the company remains unyielding.

Further to the above, I have some more dues with the company for which I have submitted the bills to the factory manager (around Rs. 9000) and have sent him a calculation via email.

I have duly noted the information provided above. I was solely responsible for managing the orders, while also ensuring that my General Manager was copied on all the emails.

I was instructed to procure the materials either by our GM or the buyer. To be candid, I inadvertently missed placing an order with one supplier.

Regarding my resignation, it was not acknowledged via email but was verbally confirmed.

Furthermore, my immediate superior did not provide any written instructions to refrain from coming to the office the following day. However, I have documented this in an email sent today, and he did not comment on that particular point.

I acknowledge the advice to seek guidance from a labor officer.

You should immediately deny all the allegations leveled against you as false and as an afterthought to deny you your legitimate dues. Reply to each allegation and ask them to settle your dues soon or threaten them that you will take legal action.

Wait for their reply, and if no reply is given, approach your area Labor Office and lodge a complaint.

I would advise a polite letter denying the allegations. Briefly inform them that your actions as a merchandiser were also a result of demand from departments, and copies of all emails were marked to the GM. Verbal acceptance of resignation has no real legal meaning as it can be denied. These allegations are related to which period or how many days/weeks prior to your exiting. Be very polite and precise in your words, but ask for the release of all dues to you immediately. Think of meeting the labor officer of the area.
