I am working as a Business Development Manager in a company. Now, the employer says to look after the HR Manager position. I do not have any experience in HR. Can I hold the position of HR Manager without an HR degree as per labor law? Please advise.

Yes, you can hold any position in a private limited company if management decides to appoint you to the same.

Normally, for any job, employers seek qualified individuals. However, it is not mandatory that HR cannot be handled by a non-qualified person. Working in an HR role is very enriching as you learn a lot, such as people-to-people interactions, labor laws, and more. One can always pursue a diploma in HR and learn while working, using common sense initially.

How large is your firm? How many employees and branches do you have? Is this appointment temporary or permanent in nature?

Certainly, you can hold a position in HR, at least in the private industry. The important question is, are you willing to change your career path since you have already specialized in a specific field.

Dear ...,

The qualifications for HR personnel serving as Welfare Officers in factories are laid down in the Factories Act of 1948 and its Rules. It is evident that you are not currently meeting these requirements. However, there are no other legal shortcomings on your part. The management, likely recognizing your strong 'people skills,' is considering entrusting you with additional responsibilities within the HR function. HR offers unlimited opportunities for career growth and personal development. While your lack of professional qualifications may initially pose a challenge, having a competent team to support and advise you can help you effectively manage your responsibilities. With increasing experience and knowledge, you will acquire the necessary competencies to carry out your duties more professionally.

Thank you.

Dear Friend,

You can take charge of the HR aspect of your organization if you have the confidence to manage its day-to-day operations. You can work as a HR manager but cannot serve as the welfare officer of the organization without the necessary certification.

Please let me know if you need further assistance.

Best regards,
