BGV Issue - Terminated from second last company because of performance issue - no relieving letter

I am working at XXX Technologies currently and have been here for the last 5 months. XXX conducted pre- and post-employment background verification and it was cleared. I am currently allocated to a client project in the banking sector. This project is conducting a third-party background verification process, which has been ongoing for the last 2 months. During this verification, it was discovered that I was terminated from my second last company due to performance issues. However, in the experience letter provided by my previous employer, it clearly states that "my performance was satisfactory during my tenure and I resigned on my own accord." On the background verification form at XXX, I indicated "resigned" as the reason for leaving.

Now, they have identified this as a discrepancy. They have requested my experience and relieving letters, as well as bank statements. I have provided the experience letter and bank statements as I do not possess the relieving letter. All documents provided are genuine. My concern is whether there is a possibility of being terminated due to this discrepancy. If so, what steps should I take to protect my current job and future job prospects? Being terminated could potentially raise a red flag on my background verification, making it challenging to secure a future job. I would greatly appreciate expert advice on this matter. Please assist me.

From your narration, it is discernible that you are only a contract employee to the client of your employer who had already been satisfied with your background before and after your appointment with them. Therefore, it is quite unwarranted for the client to conduct a further background check and find discrepancies based on subjective opinions. Even if the client insists on their subjective assessment, the most they can do is ask for a replacement. If your employer (HCL) attempts to terminate your employment based on the client's misconceived findings, it would be considered bad HR practice and an illegal termination. I don't believe it will result in you losing your job. In any case, try to positively persuade the client to whom you are providing services and keep the HR department of HCL Technologies informed about the situation.

Hi, how come the HCL verification to your previous HR and third-party verification to the same previous HR bring out different feedback? Please ask the HCL HR and the third-party organization to show you the reports first.

Secondly, most companies do ask employees to leave due to non-performance but to secure their next jobs, they issue relieving/experience letters. If you have the same, then you don't need to worry. Show the same to your HCL HR and tell him that he took you onboard based on the submission of all documents first.

Convince the team that the previous employer is targeting you for no reason. It took the third-party organization 5 months to get the feedback?? You have given your precious 5 months to HCL but if you have submitted any fake documents or if you have hidden facts that can lead to your separation with immediate effect, then we might have a problem.

Dear Friend,

Many companies give a similar reply to the BGV; hence, it is not a discrepancy but is open to interpretation. An experience letter is also a relieving letter. Many companies issue only an experience letter. As far as your documentation is concerned, it is in order.

Hi, I have worked in a small organization, let's say Company A, and I have a relieving letter. After that, I took a break for 2 years due to various reasons such as business and so on. During this gap, I underwent training and secured a job in another company, let's call it Company B, which was irrelevant to my field. Consequently, I left that job after 7 months as I found a job in another small company, Company C. Although I have the experience letter and joining letter from Company B, I left Company C without obtaining an experience letter. However, I do have the offer letter and pay slips from Company C. I received a good offer from a medium-sized company, Company D, where I have been working for over 7 years now. Currently, I have an offer from an MNC. How should I provide all my information to this new company for background verification, considering I do not have an experience letter from Company C? Any suggestions?
