Joining without relieving of last company

Is there any procedure to enroll a candidate without previous companies relieving? How shall we enroll that candidate under PF?

Is there a procedure for enrolling a candidate without obtaining relieving documents from their previous companies? How can we enroll such a candidate under the Provident Fund (PF) scheme?

There is no connection between the relieving letter and the PF enrollment. You can enroll the person on the same UAN. The PF does not ask for a relieving letter. But yes, there could be problems regarding why the candidate was not given a relieving letter. Therefore, it is a blind game you are playing. To enroll in your company, you have your rules, and PF has their own.

It is wise for the employer to ensure that the employee is properly relieved from the previous employer. Even if the employer does not bother about it, the liability is that of the employee. If the employee is not properly relieved and at a later stage the previous employer starts any action against the employee, the employee will have to face it at his cost. If that comes in the way of his present employment, the employer can tell him to quit.

In such cases, his/her UAN does not link with the current as it is stated that "this UAN is already enrolled with another company." How can we enroll him/her with the current organization?

Dear Mr. Dubey,

As already informed, please ensure that the employee exits from his previous employment with a relieving letter. You have admitted that the employee's UAN is already linked. Please ensure the previous employer files the PF exit. Why are you taking on an employee who is already on the rolls of another employer?

Just ask the employee to provide a signed letter stating that the employee has quit the right way from the previous employer, has completed all formalities, has no obligations, and understands that all liability is on the employee if the previous employer decides to recourse to legal remedies.

On receipt of the letter, publish a response letter stating that you acknowledge and, on humanitarian grounds, will extend all employment benefits. Transfer or enroll the employee for UAN.
