Relieving Letter Delay - How To Join New Company?

Hi all,
I was about to terminate by company. But considering my experience they had agreed for smooth exit. And I tendered my resignation on same day and I handovered all duties and responsibilities. But hr told me that they cannot provide resignation acceptance letter, because it is ASK TO LEAVE case. And he told dat he can provide relieving letter after 30 - 45 days. But I am having job offer where I hav to join within 30 days. Kindly suggest how can I join in other company? Or how to get letter from HR.
Note : i got offer before this incident happen.

Please explain why you were about to be "Terminated" But considering your experience your Employer agreed for smooth exit? You submitted your Resignation, which has been acknowledged by your Employer? why your Relieving Letter has been held up, inspite of Handing over Charge?The reasons must be known to you only?You can report for duty with your Employer, informing him that you have not yet received Relieving letter

Releiving letter should not be so long, but the only option you have is to amicably get all required documents.

I have written my resignation on paper and submitted, unfortunately I do not have the copy. I am following up with ER he is telling it will take 45 days to issue relieving letter, but he is nt giving my resignation acceptance letter. And also i came to knw that my resignation accepted by department head. Kindly suggest that, is ER intentionally doing this? Or this is the procedure to follow as per policies?

The employer has not terminated you and have asked to resign, hence you cannot force them to do what you want them to do or else they will simply terminate you. Hence as said earlier the only option available with you is to get things sorted out amicably across the table. Termination letter will be a spot on your career so do not instigate them to issue it.

You may get in touch with your new company and ask for some more time for submission of reliving letter. As normally many companies give grace time for submission of reliving letter. Also, meanwhile they may conduct your reference check from your previous employer.

If u have submitted a resignation, you should insist for acceptance letter, or any kind of communication indicating that u have left the company.Anyway get the matter sorted out before joining the new company. This is essential.

1. If an employer asks an employee to resign it is his duty also to ensure that all allied activities are done simultaneously as this is an exit which employer wanted and employee obliged the employer by not contesting the issue due to long term career consideration.

2. If an HR says that the RL will take 45 days they are lying are absolutely incompetent. Giving acceptance letter is part of resignation process this also shows their lack of understanding of the process. The acceptance letter ensures that now the said resignation is final and can not be withdrawn.

3. You should prepare one resignation withdrawal letter and meet the HR ask them either to give you RL or acceptance immediately or you will withdraw your resignation and will stake a claim for rejoining. Do not request them for letter ask it as a matter of right firmly but politely as the HR now lacks H of the HR and now a days they are R only.

Thanks fr ur inputs bharat, i do agree with you. I knw most of the HR do not hav humanity. They want to take revenge on employees.
But I like to see any HR to be respond on this case.

I do not agree on revenge part as I am also an HR Professional. They may have their own problems and there are people every where who do not like to walk an extra mile.
