Laws Of Third Party For Their Employees.

Hi,

One of my friends is on third-party payroll, and his site location is not mentioned in his offer letter. His third-party company only mentioned their company name in the offer letter and deputed him to another site (third-party site).

Please tell me if we have the right to ask them to mention the third-party name in the offer letter or if there is any law that states the employer should mention the third-party company name in the offer letter of the employee. The HR is refusing to mention the third-party company name in the offer letter and is harassing my friend by threatening to fire him from his designation.

In my opinion, it is not mandatory to mention the third-party location in the offer letter. The third-party location may keep changing during his tenure of working. This issue should not be of any concern since he has the offer letter of the company on whose payroll he is working, and all the statutory obligations are met by them. However, at the time of separation, he can request his employer to mention the client's name in the service certificate.

Even though I'm of the same opinion, it need not be mentioned in the offer letter. Anyhow, his hiring and firing should be guided as per his appointment letter.

We are a new small firm with 5 employees. We want to cover our employees' payroll services under a 3rd party only for statutory coverage of PF/ESI/PT, etc. Can anybody share a sample appointment letter?
