Gratuity For Contract Employee

Hi Ajay,

I was appointed in a company through a Staffing Consultancy on a six-month contract. The contract is renewable after six months. After one year, I had to transfer to another Staffing Consultancy, but the management and conditions remained the same with a six-month contract.

In the second company, I worked for 4.5 years, and in the first company, I worked for 1 year. Now, I have been terminated. Am I eligible for gratuity and a bonus?

Please clarify what you mean by "Now I have terminated." Please provide necessary details. Please peruse your question once again.

If you have continuously worked under the same principal employer for more than 5 years without a break, you are eligible for gratuity. Please submit your gratuity claim to your last contractor with a copy to the principal employer. Later on, approach the Controlling Authority, i.e., Assistant Labour Commissioner, with all documents. You have to implead the principal employer together with both the contractors under whom you have worked in your claim for proper adjudication of the matter.
