Time To Replace Members Of Internal Committee Under Sexual Harassment Law

Section 4(3) of the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act reads as follows:

"The Presiding Officer and every Member of the Internal Committee shall hold office for such a period, not exceeding three years, from the date of their nomination as may be specified by the employer."

Organizations that had formed the Committee by February 2014 need to replace the members of the committee in accordance with the above provision.

Yes, the Presiding Officer and/or the Member, including the Member (External), who are nominated by the Employer, are certainly eligible to be renominated on the expiry of their respective terms of previous nominations, at the discretion of the Employer who just has to keep in mind the recommended/mentioned eligibility criterion.
