Need Clarification Regarding Appointment Date Of Old Employees Who Are Coming Under The New Slab Under ESIC Act

Respected All,

As per the newly revised Act, a few of our employees have come under the slab of 21,000. We have already registered them as new IPs but we have mentioned their APPOINTMENT DATE as per the actual appointment date in our organization and not from 01.01.2017.

We would like to know if this process is correct and whether there will be any problem later on regarding the old Appointment Date. Also, we have mentioned the old IPs of a few employees who once went out of coverage, e.g., on 1.4.2014, Emp A got a salary of Rs. 14,000/- and his IP was at that time, suppose 45. On 1.5.2015, he got 16,000/-, so he was out of ESIC coverage area, and his contribution was stopped from 1.10.2015. As of 1.1.2017, his salary was 18,000, so he was again in the ESIC fold as per the new notification. In that case, do we have to issue a new IP or continue the old IP, i.e., 45. Please note that he made his ESIC CARD, etc., with the old number, i.e., 45.

We are a little bit confused about this. Others' views are solicited.

Thank you.

Please note that there is no correlation of the date of appointment of an employee with the date of coverage under the revised or enhanced limit by ESIC effective from 01.01.2017. This is the automatic coverage date for those employees in an organization whose gross salary is Rs. 21,000 per month.

DOA will be 01/01/2017; however, after adding, you will find that the original date of the 1st appointment remains unchanged.
