Can I Break My Service Agreement For These Reasons. Please Provide Me Any Assistance.

I am working at a company XYZ. Initially, before signing a 3-year service agreement, I want to quit the company due to the following reasons:

1. They haven't regularized me so far. They mentioned that since I signed a service agreement for 3 years, I will be designated as a trainee for the complete 3 years.

2. After 6 months, they said that salary and other terms would be revised, which actually didn't happen. They are just playing with the point that they will be revised at a relevant point of time.

3. They make us do night support once a week starting from 10 AM in the morning till the next day at 5 AM (19 hours). We need to be back in the office by 3 PM on the same day. They don't provide any extra allowance or transport for going home.

4. No E.S.I. and P.F. benefits provided.

5. Just a month ago, they suddenly revised the company terms, stating that the notice period is now 3 months instead of 1 month, and everyone should sign off on it. I initially refused as the terms mentioned before signing the service agreement were not fulfilled. However, they forced us to sign, stating that they would implement it whether we agreed or not.

Can anyone please provide me assistance? I am from a middle-class background, and I don't want to get involved in any legal troubles. I don't have any trust in Indian laws as they seem to favor the wealthy. I am not happy working in this environment. Can you please tell me if I have any rights to discontinue from this company?

Please state the nature of your employment, the nature of your company, and the total number of employees for better advice.

Since you have mentioned that you do not want to proceed legally nor do you trust Indian laws, I am sorry to say, you do not have any remedy.

Hi,

Yes, you have the right to discontinue your services. Simply give your resignation to your manager, serve the notice period, and walk out. But before all that, please search for another suitable job. If you don't want to get yourself in trouble, it's better to take an exit route on a good note.

Please note that developing company culture and employee benefits are the responsibilities of management. Therefore, even if you give your feedback to them or revolt, you may or may not get it, but surely you will invite troubles for yourself.

To be precise, with a calm mind, look for another job, then quit your current company.
