Discussion On PF & ESIC Registration

Dear All,

I require your suggestions. I am working in a company as an HR executive. Here, there is no PF and ESIC facility available. Also, the company is not registered for PF and ESIC.

Please suggest what I have to do for the same because I have discussed it many times but have not received a proper response.

My questions are:

1. Can a company operate without registering for PF and ESIC?
2. Is it up to the company to provide PF and ESIC facilities to their employees?

1. A company can operate without registration of EPF if its employee strength is less than 20. For ESIC, the employee strength should be less than 10 to operate without registration.

2. EPF can be voluntarily registered by the company even if the employee strength is less than 20. However, ESIC cannot be registered voluntarily. If the company does not comply with these regulations, EPFO and ESIC will claim arrears from the company.

Go ahead and inform your management about the laws pertaining to the EPF and ESIC. You can download the acts from the links below:

Get it registered as soon as possible. You can appoint a consultant to complete this work or register your company online. Delaying may lead to having to pay the employees' and employers' contributions with interest and penal damages. It is important to address this promptly to avoid any issues.

1. Sir, please indicate in your remarks how many total persons (including casual, temporary, on contract, etc.) are employed/working in your establishment.

2. Regarding coverage under the ESI Act, it is also required that the area where the establishment/unit is located must be an implemented area under section 1(3) of the said Act. This can be confirmed from the nearest office of ESIC.

It's purely your discretion whether you are willing to work for a company where no PF and ESIC facility is available. It is also the company's discretion whether they wish to get registered for the same or not.

So, your first question is null and void as to whether the company can run without it or not. You should only concern yourself with what you want.
