Hi,

I have some doubts about the overtime policy on Sundays. If an employee works on Sunday as overtime and the company pays him according to the overtime policy, my question is as follows: if the company pays overtime as per the norm, should they also give any weekly off to their employees on any other working day? If the employer does not provide a weekly off to the employee when they are paid overtime according to the norm, can this be considered acceptable?

Hi Mr. Pragya,

No, it cannot be accepted. As per the Factories Act of 1948, Section 52 (Weekly Holiday) specifically mentions that NO ADULT WORKER SHOULD WORK FOR MORE THAN 10 consecutive days without a whole day's holiday.

Therefore, you must provide a full day of leave to workers who worked on Sunday in the immediate working days of the week.
