Employer Not Paying Salary As Mentioned In Offer Letter

Hi guys,

I am working for a very small company that has employees in the single digits and is not paying the salary as mentioned in the offer letter. I am referring to basic salary, House Rent Allowance (HRA), and travel allowance. There is also a performance allowance, but I am excluding that. The owner is saying that they will pay as they want based on performance, and that too after around 50 days. There has been no revised offer letter. The salary given is much less than what was mentioned in the offer letter. This has happened to some (most) of the employees before. Please suggest if any legal action can be taken.

Your counter-query 'Is there any chance of negative action against me' gives an impression that you aren't aware of the FULL gamut of the possibilities of going legal... not that going legal is wrong. And to answer this query—one can't rule out any counter-action against you... obviously IF you were in your boss's position, would you just sit waiting while getting badgered... legally or otherwise? A few more inputs from your end will enable the members to give you more actionable suggestions:

1] How long did you work here?
2] What's the reason... to the best extent you know... for your Employer not paying the full salaries or delaying them?
3] What did you mean by "He has done this with some (most) of the employees before"? Is it 'some' OR 'most'?
4] First and foremost, going legal would involve expenses... that's one of the premises made by Nathrao. Are you OK with it?

Mr. Don't want to tell my name, consult a lawyer. He will tell you his charges. There are many ways to prove less payment - offer letter v/s amount credited in the bank, etc. The lawyer will explain the matter in full.
