Understanding ESIC Exemptions and Regulations in Kerala for Employee Benefits

Please let me know the ESI exemptions in Kerala. If we have some employees who don't want to use the ESI benefits, are there any exemptions available for them?

The current ESIC exemption limit is ₹15,000 Gross. As per your state's rule, if any organization has 10 or more employees and if any of the employees' salary is less than ₹15,000 gross Salary, ESIC is applicable. According to the ESIC Act, the employee or employer cannot deny the benefits of the social benefit scheme.

Dear member, the ESI Act of 1948 is a central Act that is applicable to all implemented centers in India. There are no specific provisions for exemptions for any particular state, such as Kerala.

All employees receiving wages (as defined under the said Act) up to and including Rs. 15,000 per month are covered under the Act, provided that the unit is located in an implemented area.
