Unexpected Termination

Savitri143
My employer has terminated my job without giving proper intimation and reason. The reason they have given to me is poor performance and inability to meet targets. I joined this firm on 3rd March 2014. I received my 1st-month salary (for March 2014) on 15th April 2014. However, on 15th May 2014, my employer suddenly informed me about my termination citing the above reasons. At the same time, my employer falsely assured me that they had deposited my April 2014 salary into my account and that I would receive my next 15 days' salary from May 1st to May 15th, 2014. Unfortunately, I did not receive my salary, nor did I receive a termination letter. Despite my daily messages and emails to my employer regarding my due salary, I have only received false assurances from them that my salary will be deposited.

Regarding my performance, I work as an SEO (internet marketing executive), and my performance is evaluated based on website performance and suggestions made to clients. I have communicated with my employer numerous times about necessary changes, but they have not taken any action. How can they judge my performance when they have not fulfilled their responsibilities? I have an offer letter and a salary slip for my 1st-month salary (which was deposited).

Please advise me on what steps I should take in this situation. Can I file a complaint?

Contact your employer in writing by sending him another letter or email stating that your past oral and written reminders have fallen on deaf ears. You are entitled to wages for the period worked and have been illegally dismissed without warning, a chance to respond to allegations of non-performance, etc. The dismissal from employment is based on the terms in the offer letter, so you will know better how to word the letter accordingly. Claim your outstanding wages and address the unfair dismissal without the opportunity to reply. Inform them that if your letter remains unanswered or dues are not paid within a reasonable time (say 15 days), you may have to seek legal recourse at the cost of the company.

Prepare to fight by hiring legal help. Your preparedness to take this issue to a logical conclusion is key. So, reflect on this and act accordingly.

All the best.
