I am inform as follows:-
1. Coverage under ESI Act is by two ways i.e. (a) firstly, under section 1(3) vide which all factories employing 10 or more persons and located in implemented areas are covered. (b) secondly, under section 1(5) the appropriate governments i.e. State Govts. have been empowered to extend the provisions of Act to other classes of establishments.
2. Therefore, I will suggest you to go through Section 1(5) of said Act alongwith notification issued by the respective State Govt. where your establishment is located.
3. For your kind information and so far as I understand, the State Government of Karnataka has issued notification u/s 1(5) dated 16/03/2011 vide which shops, hotels, restaurants, road motor transport establishments, cinemas including preview theatres, newspapers establishments, educational institutions & medical institutions employing 10 (ten) or more persons are coverable under said Act.
4. Therefore, if your unit is located in implemented areas of Karnataka State and employing 10 or more persons and falling in any of above category, then definitely the same is coverable under said Act and compliance is required to be made.
