Pay The Amount Which They Have Invested On Me. Or Work Till They Get There ROI

yogendra.bhandari21
Hi,

I started working at a training company in April 2014 and completed a one-month boot camp. After 1.5 months, including the boot camp, I resigned from my position by giving one month's notice due to personal reasons.

Two days after resigning, they called me for a meeting and informed me that I needed to repay the amount they had invested in me or work until they received their return on investment. According to my offer letter, I am required to serve a one-month notice period during probation. Additionally, my appointment letter states that during the probation period, resignation or termination can occur from either the employee or employer's side.

There is no mention in my appointment letter about repaying any invested amount. Please advise me on how to resolve this issue and be relieved from my duties.

Thank you.

Dear Yogendra,

Have you signed any agreement or bond with your employer? Is there any clause mentioned in your appointment letter regarding leaving within 1 year or 6 months, where you would need to pay 1 month's salary?

If you have signed an agreement or bond with your employer, there will likely be a clause stating the validity of the agreement or bond and the financial penalty you would need to pay if you do not fulfill your service period.

If none of the above questions apply to you, I suggest that you speak with HR to discuss the terms or negotiate any conditions that may be affecting your situation. It's important to have a conversation to reach a mutual understanding and resolution.

Please let me know if you need further assistance.

Best regards, [Your Name]

Hello Ankit,

I have not signed any sort of agreement or bond with the employer, and there are no such clauses as you have mentioned. Now, please suggest the right course of action.

Dear Yogendra,

You stated you have a personal reason to leave. Would you be able to share what it is? Your situation looks pretty clear. Please send them a registered letter stating the end of your service. Since you didn't sign any document, you are not bound by any clause. What they have informed you recently wasn't signed when you joined them.

On the other hand, on humanitarian grounds, as a business, if they made any investment in you, try to pay it off. Your employer is equally human and can't take the jolt. If you have genuine reasons to leave, find out the best way you can help them out and pay them off. If not, at least help them find someone who can deliver what they need.

I am making assumptions and suggestions to you. I am sure you have a better view of what the situation is and will find the best way out! All the best!

In that case, draft a letter stating your resignation and the fact that you need to be released at the earliest. Get an expert to proofread the letter. Attach the medical certificate and send it to them as a registered letter. There is nothing they can do legally beyond this.

Wish you all the best!
