Breach Of Bond

i have joined one company by signing 3 years bond on stamp paper and given 50000 r.s. un dated cheque.
but after working there for just 7 days i found working is totally different to my work profile and what i understood in interview,
i can not learn anything because it is out my work field and even i don't want to learn because i don't want to change my field.
job profile is not explained in offer letter.
i met hr-head and explained my problem.he said give me resign and mention you are resigning because of your personal reason then only we will waive off your money.
i obeyed same and given resign as he said but after one week i got call hr department that as per top management decision i have to pay 50% money i.e. 25000 r.s. by demand draft then only they will return my undated cheque otherwise they will deposit it.
i did stop payment for cheque.
please guide me in this matter what should i do?
should i pay draft?

Dear Juhi,
You have just worked for seven days.You have not even completed your induction there. Don't worry, you have nothing to loose; forget about those seven days and its salary.
Start looking for better options and be careful this time before signing any service bond and be more careful while choosing career options available before you. Choosing a career option just like that may create more such nightmares from which you have just came out.

I am sure you have the cheque number. Do a stop payment right away. You need not pay the draft. Since you have only worked 7 days you need not mention in your resume but do mention in the next interview to ensure a transparency.
And pls understand the next job profile beforehand.

Since you have already asked bank to stop the payment, they would not be able to transfer the funds.

You need not pay the amount.

Bonds are not legally viable unless formal training is given.

However, would also give you a word of caution and a piece of advice for your future.

1. Whenever you apply for a job, please do not get carried away by the position / title / designation that they are offering or the package they have quoted.

2. It is a rising trend that at the end of the interview, the interviewer would ask you if you have any queries to be clarified. Even if they don't ask you, you should ask your queries in the interview itself by politely asking to clarify on certain queries you have and ensure to have covered foll questions -

..... < a > What is the job role of the position OR If I get selected, what do you expect me to perform?

..... < b > What is the working culture of the organization? (Please understand that working culture is different from working hours. The typical 9-5 jobs are long gone and we can't expect to get one in this job crunching age. However when you ask for work culture, perhaps you would get some hint of work hours as well)

..... < c > What is the basic business of your company apart from (whatever you understood from your homework - studying about the Co from web)

..... < d > What would be my KRAs and how would I be judged on my performance.

These are a few questions that would help you get an insight of the company. Apart when you are going for the interview, that is also an opportunity to notice the workforce, the culture, people there etc. Take that opportunity to examine if you'd be comfortable in that office.

Do not worry this kind of service bond is not at all enforceable under any law in India. Since you have already done the stop payment of the cheque do not worry they will not be able to do anything. If at all they do anything you can do a counter case on them as this type of bond comes under forced labour which is punishable by jail also. So it is very very much less likely that they will take any step.
