Understanding Employee Entitlements on Poll Day: Legal Insights and Practices

Praveen30
Dear Seniors,

Kindly guide me if there is Sunday on election day. Can we get additional holiday against this?

Thank you.
AG Desai
This is a special holiday to enable the citizens to cast their vote. If Election Day is Sunday, employees are not entitled to a holiday on any other working day.

Dear Praveen
Yes, Mr. Deshai is absolutely right. Just I would like to add for your information that it may be Sunday or any other Holiday observe by your establishment there is no need of any substituted holiday to be provided.
as per legal requirement if any industry comes under “continuous process industries” only short leave may be given just to facilitate the casting of vote even full day leave is not required to be given.

Dear Praveen,

In our organization, which is a continuous production company, we allow employees to arrive late by 2 hours to cast their votes. Employees who arrive 2 hours late on the same day are checked to confirm if they have indeed voted, based on the voter's mark on their finger.

No additional leave is admissible on account of Poll day falling on Sunday. Further, Poll holiday is only for employees in the General shift, from 08 AM to 05 PM. No leave is granted to employees who are in A, B & C Shifts.
