Esic Return-after Online Implementation - PDF Download

Dear All,

Since we have implemented online generation of ESIC challans last financial year onwards, do we need to file the ESIC return for this year? We have contacted the ESIC department regarding the same, and they have informed us not to file any returns from now onwards. We have several contractors working with us, and they submit the copy of the ESIC return to us. Please advise on what documents we should start taking now onwards related to ESIC.

Regards,
Ranjeet

Hi Ranjeet,

Please see the attached circular from ESIC. As per the same, it is not required to file manual returns.

Vijay

Dear Vijay,

Thank you for your response.

Could you please advise me on what documents we should obtain from the contractor as a principal employer to ensure that every employee hired through them is covered under ESIC?

Please advise.

Ranjeet

Respected Seniors,

Nobody has responded to my post. I once again fervently request a signed circular from the concerned authority for non-filing of the Half-Yearly return (Form 5) in regards to ESIC.

Hope for your kind and early response.

Please upload the signed document from HO Delhi for the non-filing of the May 2012 circular regarding the non-filing of ESIC Form 5 (regular) for the RC period from October 2011 to March 2012.

Your kind anticipation is appreciated.

Dear Seniors,

Thank you a lot for your kind response to my post. Actually, I was looking for a signed circular from the HO Delhi or any RO, or a copy of the previous letter issued for the first time after the online system in ESIC was implemented, i.e., after the completion of the RC period from April to September 2011. If I am not mistaken, the circular was 67/Dir/Misc/SPOC-REV dated 08/11/2011 issued to all RO/DO/HO.

Thank you once again.

Warm Regards,

Dear All,

I would like to inform you that the ESIC Social Security Officer of your area. You need not file hard copies of half-yearly returns, as they are generated automatically and can be verified by ESIC officials using the "VIEW RC" link on the ESIC website.

The ESIC half-yearly returns have been made online. There is no requirement for employers to submit the ESIC return at the branch office. However, there have been updates regarding the letter dated 25th April 2012 with Ref No: G-32/11/6/31/2012/DIR-ICT/Misc, stating that for the Contribution Period Ending March 2014, employers are not required to submit hard or soft copies of the Return of Contributions. It is clarified that employers are not to be asked to submit hard copies of RCs for CPE March 2012 under any circumstances. Since October 2011, no employer has been allowed by any RO/SRO/DO to file monthly contributions using manual challans.

According to the ESIC notification, any vendor (employer) holding an ESIC Code or sub-code must submit self-certification by uploading a CA certificate if the employee (IP) strength is over forty during that period. They should also submit a copy of the acknowledgment to the principal employer to demonstrate compliance.

For vendors (employers) whose employee (IP) strength is less than forty, it is required to generate online returns from their respective portal.

Our factory covers ESIC from 1st March 2017, and we enter the joining date of employees as 1st August 2016. Any problems occurred?
