Regarding Issue Of Releiving Letter From Company

Hi,

I am working in a service provider company. The company has just signed an agreement with me for 24 months plus a 3-month notice period. The agreement is on simple paper, not on any stamp paper. I have been working there since March 2011. Our HR informed us that if I break this agreement, I would need to pay six months' salary.

Now, I have received a good offer from another company with a better salary package. I am willing to pay the amount, but now they are saying to wait for 3 months and also demanding six months' salary. However, this was never mentioned at the time of joining, and it is not written in my agreement. I need to move on as this opportunity could be a turning point in my career and help me fulfill my parents' dreams. Can anybody help me with this situation? I am feeling very frustrated.

My agreement is not on company letterhead. It is just about 10 sheets of white paper on which only the "true copy" mark is stamped; neither is it a bond nor stamp paper. Additionally, there is nothing written in the agreement stating the amount you have to pay if you break the agreement. I am in urgent need of relief, but they are just extending it.

Ma'am, please help me out. I do not want to leave this offer. Please help me.

If your new employer is not insisting on a relieving letter, just quit and go. They can't do anything to you with that plain paper thing.

Yes, if you need the relieving letter, then you need to close the loop amicably. Sit with the head of the department or branch, whoever it is, and try to resolve the issue.

We have a number of employees leaving us, and management does not take any action. If you don't have much Full and Final settlement to get and don't want a relieving letter, just go and enjoy.

Sorry, but my new employer is demanding the letter. Actually, I am working on the client site where we are given work on a daily hours basis. We are not authorized to handle a single project. My company's head office is in Chennai. When I asked the HR there, she told me that any project you handle. So, I explained about my work here and also mentioned that the project leader under whom we are working here said that if our parent company allows, I can be relieved in a day. Our HR in Chennai informed me that the HR in Pune can provide the letter if they allow. However, the HR in Pune is stating that the Chennai office is not permitting us to issue the letter.

Can anybody help me with this? Is there any legal action that I can take? If so, how much time will it take to get a judgment? Please, can anybody here help me with this?

Hi, can I know your company details, just to blacklist in my career? As far as your problem is concerned, the office that issued the offer letter and appointment letter is also responsible for relieving you from your responsibilities. So, if it is the Pune office, then do give your letter of resignation as per the time limit mentioned in your offer letter, if any. If nothing is mentioned in your appointment letter, you should be relieved immediately. Such companies relieve easily. Just approach a lawyer and issue them a notice. They will surely bend down. Try it. You may have to spend a few bucks. But in case, please try to relieve amicably because this becomes a remark in your career if the news spreads and your new employers seek verification from the old employer for references.
