Workmen Compensation And Personal Accident Insurance

Dear All,

We have branches pan India. We are covered under the ESI Scheme, with all branches except one falling under the ESI Non-Implemented area.

We have a Personal Accident Insurance Policy for all employees, irrespective of their designation or salary.

1. Should we take out an Employers' Liability Insurance policy for employees working in the branch located in the ESI Non-Implemented area, in addition to the Personal Accident Insurance we already have?
2. Do we need to cover employees whose salary exceeds Rs. 15,000 and are therefore out of ESI coverage, under the Employers' Liability Insurance, in addition to the existing Personal Accident Insurance, or is the PA policy sufficient?

Accidental insurance policies do not cover workmen's compensation clauses. Therefore, you need to take out a separate policy as per the Workmen's Compensation Act for employees not covered by ESI.
