Understanding Gratuity Eligibility: How Is the Five-Year Service Period Calculated?

ravisankar2503
Dear all, I have the following doubts regarding gratuity eligibility. Can any of you please explain the following:

1. Is a five-year service period calculated as 4 years + 240 working days, or is it considered as a continuous 5-year period?
2. Should this five-year period be counted up to the date of resignation or the date of relieving?

Thanks in advance,

Regards, Ravi

In my opinion and as per the Gratuity Act, five years for gratuity eligibility is calculated as four years plus 240 working days. Five years should be considered up to the date of relieving.
