Handling Unauthorised Leave as per Bangladesh Labor Code 2006: Procedures and Compliance

If an employee is absent from work without taking permission or informing management, what action should be taken according to the Bangladesh Labor Code 2006? Can we terminate them if this practice occurs regularly? Can we add such a clause in the appointment letter? If anyone knows the answer, please help me.

Dear Kegotumi,

Please check Chapter IX "Working Hours" and Chapter X "Wages and Payment" in the Bangladesh Labour Act 2006 to have a clear idea about your query. If any worker is absent for more than five times, and you have issued a warning letter and imposed any punishment for their absence exceeding three times, then after conducting a proper inquiry, you can terminate the employee. You do not need to provide these details in the Appointment letter. You can include all these clauses in your company's Discipline Policy within the HR Manual.

Thank you so much for sharing your knowledge. I went through Chapter IX and X of the Labor Code 2006 but could not find the answers that you mentioned. I am confused whether I am using the right book or not. I have downloaded it from the Bangladesh Ministry of Law website. Can you please show me the link or mention the section or subsection where I can find clear evidence about my queries? That would be really helpful for me.
