Please suggest a spouse for me. I am on leave from Saturday to Tuesday. Does this condition include Sunday or not?

Hi Rohit,

Of course, even Sunday should be included in the holiday. Moreover, it depends on the management. In some organizations, Sundays will be exempted.

It depends on the organization's policy! The majority of companies would count Sunday as part of your holiday; however, there are exceptions.

Further, I have taken leave from 2nd May 2011 (Monday) to 21st May 2011 (Saturday). Should we deduct 1st May 2011 (Sunday) and Sunday, 22nd May 2011?

No CTI.HR099. 1st and 22nd May 2011 are considered as prefix and suffix for the leave, and his leave period is only 20 days.

Hi,

I suggest you refer to the company policy related to leaves. I have seen many companies that only count working days for deducting your casual leaves. If you avail of medical leave or loss of pay, generally calendar days will be counted.

The matter in question is critical, and what is suggested is based on normal and common practices, not on a legal point of view.

Under what provisions of the law your organization is applying might have been considered here. Whether it is under the Shops & Commercial Establishments Act or the Factory Act, then only we will come to a conclusion.

Suppose your organization is under the Shops/Commercial Establishment Act, then the weekly off will be counted as leave. But when it is under the provisions of the Factory Act, then all weekly offs are excluded, and salary/wages have to be divided by 26, 27, 25, or 24, depending on the days in the month. Hence, the question doesn't arise to count the leave on weekly offs.

Dear Rohit,

While drafting salary SOPs, Sunday is considered as paid time off. Hence, whenever you take leave, it will include all Sundays falling within that leave period. However, this policy may vary from company to company. Please check your company's specific guidelines.

Dear Rohit,

As per the Factory Act, three working days in a week, Sunday will be a paid day without treating the leave. However, as per the Shop Act, Saturday and Monday are leave days, so Sunday will count as a holiday. Furthermore, it depends on the company's policy.

It was really a nice question. In majority Company Policies says that the Sunday will be consider if you take a leave from Saturday to Thursday.

In this case I suggest you to take a leave from Monday to Friday.

It will serve your purpose.

In many companies, I have seen that if anyone takes EL/SL leaves before and after Sunday, Sunday is included. However, in the case of casual leaves, Sunday is excluded.

Typically, Sunday should be included unless specifically mentioned otherwise in the company leave policy. However, it depends on how many types of leave are allowed by the company. Some companies that allow Casual Leave may not count Sunday in such a case. So, please check your company's leave policy.

Nothing needs to be done with company policy in this issue. Taking EL on Sunday will not be marked as leave because the calculation of EL is based on working days only (i.e., one leave for every 20 working days), not on holidays. In cases of other leaves, Sunday can be marked as leave.

It totally depends on your organization's policy. However, in most cases, weekends are included in your leave entitlement. If you take leave from Saturday to Tuesday, then Sunday will be counted as a leave day.
