Excess Salary Paid After Resignation

Hi All,
I have received two month excess salary from the employer after my resignation. They have have come back after four month for the full and final settlement. If the amount is not returned back, there would be any legal action taken or not.

White Eagle has rightly suggested, you must pay back excess payment received by you to the ex-employer.

Going through your post reg the excees salary recieved to you by your employer after resignation
1. It seems that there was lack of attention to details or you can termed it as human error that while processing the salary for active employees your name was considered even though you had left the company
2. If they have transfered your salary via bank account which was opened by them during your joining then they have a valid proof that they have made a payment to you which can make their case more powerful in labour court
3. Also you should consider on humanity grounds the amount of presure that person will be facing for wrongly procesing your salary
My suggestion would be you should pay back what ever amount they have credited in your bank account

Dear Chimmu,
It is a human error. You have to pay back the amout the company, they can take legal action agains you. Definately court will also order the same. Its better you pay them.

I have resigned and opted to fulfill my notice period but refused by my manager as he want me to relieve asap now from past 2 months i am getting my salary and my official relieving is also pending from hr side.As per mail received from hr the day i resigned my resignation was processed but still after 2 months my relieving is pending and salary is being transferred to my account.So kindly guide me how to approach for resolution of this situation.
