Can i claim my salary from ESI during my leave period prescribed by ESI doctor?

I will be going on a 5-day sick leave as prescribed by the ESI doctor. Can I claim my salary from ESI during my leave period? Please let me know as it is very urgent.

Yes, you can claim 5 days' salary from ESIC, but the company will not pay you for these five days. They will pay you according to the details provided by your HR.

You are eligible for sickness benefit of 60% of your average wage for 5 days unless you have worked for not less than 9 months and have contributed for 78 days during the corresponding contribution period.

1. Sir, no "leave salary" is paid by ESIC.

2. Sickness Benefit is paid by ESIC in case the insured person is sick and there is abstention from work, and on the basis of a sickness certificate issued by the appropriate ESI dispensary to which the insured person is attached. The claimant insured person must be eligible for such payment of sickness benefit.

3. If desired, you can download necessary literature on various benefits, the terms and conditions of payment of various benefits under the ESI Act, 1948, and rules/regulations framed thereunder from the website of ESIC or can obtain the same from the appropriate Branch Office of ESIC to which you are attached.

4. The present rate of Sickness Benefit is 70% of the average daily wages of the insured person.

Sir, please clarify which type of ESI leave was granted by the ESI Doctor. Was it sick leave or leave due to an accident? Was a certificate issued, and has it been submitted to the relevant ESIC Branch office? Has the insured person previously taken a similar leave within the last 15 days? Sickness benefits are not payable for the first 2 days if the sickness does not recur within 15 days. It would be better if the insured person contacts the respective branch office of ESIC.
