Grauity As Part Of CTC

Dear All,
I need your help on clarifying my doubts.
I have worked with an organisation, where Grauity was part of MY CTC.
Means my Negotiated CTC had a component Grauity in it.
Normally Grauity act says, one can get it only if one has worked for 5 years in an organisation.
But in my case , Grauity was part of CTC.
Shuld I get it from my company or not.
Pls. let me know details.

Dear Pankaj,
Many organizations include Gratuity (which is generally taken @ 4.80%) while arriving at the CTC. Thus, if you have completed 5 yrs. in this organization and now leaving, then claim for your gratuity, otherwise wait for 5 years.
