Hope u all doin good,:icon1:
I wanted to know if in case where employer don't provide offer letter,appointment letter to new joinees than is that OK if employee himself prepare a offer letter/appointment letter and get the sign from his boss.?
OR
is it considered as illegal?
OR
what a person/employee can do in such a situation where he's not given any offer letter/oppointment letter?

astoundingly strange situation. the absence of offer letter/appointment letter can have deep impact on the job claim iteslf!
as long as the letter is signed by the owner of the company (since the wordings are the only component introduced by the employee) and in its letterhead with offical seal, it might not end up calling up for illegitimacy, i guess.
may be our legal experts can give deeper perspective

I feel, absence of offer letter in writing and connected documents may have deep impact on legal claim.
One cannot claim any amount due to them, whatsoever, if the offer and appointment letters are not provided in written.
These are pre-requisite for an employer to be provided to employee when they intend to take for job.

according to me if u urself gve a offer letter to the new joinee then it will far more better coz the new joinee can prepare wrong offer letter....
and according to legal issue....it depends on the type of business u r running...if it is small then offer letter does not really matter and if it is big firm then offer letter really matters....

On the day one or the previous day, every effort should be to have the appointment letter. Offer letter is the one based on which you give your consent to join the company. But once you are in, then you must insist for an appointment letter. Very politely and in a straightforward manner ask for the appointment letter without which how can you start working ?
But if you go soft on this issue then you can be terminated at any point of time and may be asked to go unpaid too for all the number of days or months you have worked. Also if you are shy on day one you will be expected to keep mum in the rest of the time to come too.So don't hesitate or bring in the trust matter into the scene but insist the employer to behave professionally and give the appointment letter latest by end of business day. Failing to do so you may not like to work in an unprofessional company.

thanks alot that's what i wanted to know cuz without offer/oppointment letter its very clear that u don't have a proof at all and it'll become complete disaster when u work for long time and while changing job u have to face this question....
as of now i just wanted to confirm that if its employee's responsibility incase employer don't provide with these things....

Employee is responsible to the extent that he/she does not have any written confirmation about the job he/she does but then he/she is doing the job.
Mother does not offer milk to the baby untill he/she cries...

Issuing of appoinment letter must be centralised which looks good.
If employee himself types an appointment letter & get it singed by the Top but authorised person then they have got legal support.
If employee is not getting appoinment letter then they should get salary slip,any card issued by the authorised person,and you can take support form the company standing order where all the terms of employement are mentioned ,you should take a copy of this.
Otherwise make outsider communication with Govt dept or other department to comfirmed that i am employee of this firm and get mobile connection at the address of your office.

Hi Pradeep,
One should never start one service with any company without a proper agreement in place. In your case the Offer letter and appointnment letter is a mandatory all legal matters. Please do not do the mistake of preparing a letter yourself, this would be perceived wrongly in the legal eyes. I know in today's trying times, employees sometime ignores his basic rights and few irresponsible companies are taking advantage of this.
My Suggestion, Please do not continue any further till such time you get offer/appointment letter. This is the base on which all legal rights can be claimed. Ofcourse there are other ways, but offer letter/Appointment letter will make life easy, if things go wrong.

your suggestion made me write some more...if u cud help me in this regard...i din't get you where u have suggested me that i can get a mob.connection at the address of my office....???please explain in detail...how come it'll help me in future as a proof..???
as well as in my city...employees don't get any offer/oppointment letter...and also there are very few companies having HR dept..(2 software companies and 2-4 companies including jindal,mahindra n mahindra etc)
(as it is a developing city) here only communication between the boss and employee while interviews is considered as enough only thing they get is that salary cheque....cud u please let me know if the copy of this salary cheque can be considered as proof..???
