I have been working with a pharmaceutical company since October 2008, and I have not received my appointment letter or confirmation letter. Despite reminding my seniors and the HR department several times, I have not received a proper positive response from their side. Kindly suggest to me what to do.

There is no problem. If you insist on them or write a letter to them, they will say bye-bye to you, so there is no use. You carry on working there and learn the things. It is a mean and unprofessional approach of HR guys. If there is any problem, you can contact.

Dear Mr. Malik,

I am working as a payroll executive here, not a professional HR. Department. All HR-related activities are being taken care of by Md., JMD, and the Accounts Department. When people are not performing well, the management does not take any action. These individuals are local residents. I am very frustrated in this situation, and I would like to leave this organization. Therefore, I need my appointment letter. I believe that the management may not provide me with my full and final settlement. Some of my seniors have not received their full and final settlement amounts, and the management is harassing them. Perhaps, this is a dirty game being played by the management. I am well aware that I come from a modest family background. If they do not provide me with my full and final amount, my situation will become dire. This could affect my future job prospects. Please advise me on the appropriate course of action.

Dear Sandeep,

An appointment letter does not have any relation with full and final. When you resign, take your full and final settlement and experience letter. If they refuse to provide your full and final settlement, file a complaint with the labor department under the Payment of Wages Act.

Appointment letter is your right. If the HR is not issuing you an appointment order, you have the right to write to the MD or the Director of the company stating the facts. You should mention that you have been working with the company from such and such date, discharging the duties and responsibilities assigned to you (explain in detail) from time to time, and then request an appointment order. Dear Sandeep,

Since you have worked for such a long time in that company, my personal suggestion to you would be to make sure you get the appointment letter from the company, as well as other beneficiaries like salary slips, resignation letter, etc. Try to leave on good terms so that it won't be an issue for referencing because unfortunately, there are HR professionals who don't understand such problems. Do not take risks with your career.

Your aim now should be to obtain these letters from them. If not, then forget it; they are, after all, losing a potential candidate. The right person with the right attitude can get any job. So, no worries. Take it easy but try your best from your end to get these documents.

Don't be demoralized if your problem is very serious; you must hire a professional lawyer to help you out of this problem.

This problem could be solved by doing things without inviting any trouble. Talk to the right persons and do things step by step; don't panic, everything will be fine.

Mark an official reminder email to your supervisor and HR, requesting to accept your registration. Mention clearly the proposed last working day as per the notice period. Mention and discuss personally that you have to join another organization. Trust me, they can't hold you back under any circumstances unless you have signed some kind of legal bond.

Don't spoil your relationships here as there might be a background check in the future that could cause problems in the future.

Make sure to take acceptance over the resignation as in some organizations that is sufficient, as every HR knows the relieving letter takes time; you get it only after full and final.

I understand in such cases most of the problems should be handled with care, and one should always try to get a smooth exit by avoiding trouble. Try to keep your calm; don't panic. Best of luck.

Dear learned HR professionals,

Can anybody give an idea whether the salary break-up or CTC, whichever you prefer to say, should be one of the clauses in the appointment letter or not? It varies from organization to organization. Typically, most organizations mention the salary and its other components in the appointment letters issued to new joiners, while some do not. My point is, what's wrong if the salary or CTC break-up is not mentioned in the appointment letter? Are there any consequences to follow if it fails to mention the same in the appointment letter? I am eagerly awaiting feedback from all senior HR professionals in this regard.

I am very frustrated here, and I want to leave this organization; therefore, I should check my appointment letter. I think management will not give me my full and final settlement because some of my seniors who have not received their full and final settlement amount are being harassed by management. If they do not give me my full and final amount, then my situation will worsen. I fear that in the future, I won't be able to find another job. Please suggest to me what I should do by the rule.
