Salary For Medical Leave

Dear Seniors,
I have a case.
A Maint. Manger met with an accident in a compnay. He is taken to the doctor and doctor says everything is normal and no fracture like injury is there but the patient is adviced to take rest for 15 days by the doctor. The patient join the office after 10 days and again go on leave very next day stating madical reason of same injury. He consults another doctor and send a medical certificate for being medically "unfit to join the duty" for next one month.
Now my question is that, in this type of case, is company bound to pay his salary for the period of his being absence ? Is Company bound to accept another doctor's certificate other than company's doctor ?
I am seeking answer urgently please.

Ethically and legally he shall get half of his basic and other necessary regular allowances as medical leave as per W/C Act if he met with an accident while on duty and only registered govt. practioneres certificate for rest is valid. But a lot depends upon his nature of job and his remuneration package and Company Policies also. Still u can perform a reference check regarding the medical provided. Look further into W/C Act and check various posts regarding the same in the forum.

you may ask the your mtce manager to approach ESI for further treatment. if he is covered from ESI. since if he goes to ESI, the management will not have any burden in paying him salary or anything. ESI will pay accident benefit based on his injury and his according to his salary per day proportion. if he is out of ESI, 50% of the reimbursement is covered and to be paid from workmen compensation act. and that to depends on the nature and the extent of the injury. you may refer to the WC table and the schedule clearly states the compensation benefit (in%) to be given for each and every injury or physical disablement.
first ask him to go to ESI hospital if he is an IP and then proceed other. do not tell him to go to private medical practioner.
