Payush is correct. Although the license expires on 31st Dec., the last date for submission is 31st Oct. However, it may depend on the Appropriate Government.

31st October. You have to pay the fees and submit the form in triplicate along with the paid challan and original license at the CFI office before 31st Oct.

It is October 31, 2009, for the renewal of the factory license for the year 2010 (January to December). It may be submitted by December 31st with a penalty. For the quantum of the penalty, please refer to the Factories Act - rules applicable to your state.

As per the A.P. Factories Rules 1950, read Rule No. 6: PAYMENT OF ANNUAL LICENCE FEE OR FOR A BLOCK PERIOD OF THREE CALENDAR YEARS:

(1) Every licensee shall, before the commencement of any calendar year, pay the annual licence fee of such amount as is prescribed in the Schedule to this Rule for each calendar year or three times the Annual Licence Fee prescribed in the said Schedule in case the occupier prefers to pay for a block period of three calendar years at a time during any part of which the licence fee is valid:

Provided that for computing the quantity of power, for the purposes of this rule, the power for the plant and machinery used in the manufacturing process only shall be taken into account and no account shall be taken of the power for lighting, or for any office equipment or appliances. The total installed horsepower of plant, machinery, and equipment or the captive generation of power whichever is higher shall be taken into consideration.

(2) If the prescribed annual licence fee is not fully paid within the prescribed period in sub-rule (1), simple interest at two percent per month or part of a month shall be payable on the part of the fee not paid from the first day of the calendar year till the last day of the calendar month in which the fee together with interest is paid.

Provided that the Chief Inspector may, if satisfied that there is sufficient reason for the non-payment of the annual licence fee within the specified time prescribed in sub-rule (1), by order in writing, waive the interest specified.

PAYMENT OF FEE: Rule No. 11. (1) Every application under these rules for which a fee has been prescribed shall be accompanied by a treasury receipt showing that the appropriate fee has been paid into the local treasury under the head of account No. 0230 Labour and Employment 104, Receipts under Labour Laws - Fees realised under the Factories Act, 1948.

(2) If an application made under these rules is rejected, the fee paid shall be refunded to the applicant by the Inspector or Chief Inspector within thirty days of the date of the order.

In Andhra Pradesh, the Licence can be renewed in the month of December.

Dear Seniors,

I have just transferred to the plant location from the corporate office and don't have any exposure to the same except for a few words of mouth. The plant license from the Chief Inspector of F&B has been issued for 150 persons to our plant (including contractual and permanent employees). The current manpower strength is a maximum of 100 during the day in the previous year, as per our gate register's 24-hour turnover of manpower. The validity of the existing license is until December 2010.

Could you please guide me on how to obtain an updated license for a strength of 750 (proposed maximum manpower for the upcoming years 2011/12/13) by our factory manager? Can this license be obtained for three years in one instance?

Your early suggestions would be greatly appreciated.

You have not mentioned the name of your appropriate Government. In Haryana State, we are not required to prepare any covering letter as we are to apply for obtaining a factory license/renewal of license through the online system on the Haryana Labour Department website.
