There are benefits that you can avail from the government:
- 3 Months of PF will be paid by the government
- Govt has deferred the payment of ESI/PF which creates short term liquidity for you
As per the MHA directions, you cannot lay off/terminate employees during the lockdown period.

i would like to submit here you will have to take the permission under Section 25 M from the competent authority for the Lay-off.Beside Since, the national lock down has been declared from 23/03/2020 & the Disaster Management Act & epidemic disease Act, is in force which supersede all the applicable labour laws.
your are only considering the Industrial dispute Act and ignores Disaster Management & epidemic disease Act. As per the government orders,restricted all private sectors for termination of employment & the reduction of wages.
Considering all above points your management will contravened the Disaster Management Act & epidemic disease Act along with the Industrial dispute Act, which lead to legal action against the Company.

Dear Umakanthan Sir,

Sir we all are aware of the concession of PF but there are certain criteria that a company should be meeting to avail this condition. So pls do not assume that all companies are able to benefit from it.

For example my company is not meeting the criteria required for availing the EPFO concession so we as an company need to bear the cost.

Here everyone is thinking from employee perspective, being a devils advocate has anyone imagined the plight of the small companies, entrepreneurs, shop owners. No concession has been provided to them in a big way by government they still have to bear the fixed costs (rentals if the business space is a rented one, electricity bill, telephone bills and other expenses that one has to bear even if your company is not generating revenue. We should not forget they do not have much reserve funds.

Its high time all of us think about their plight as well.

Incase an employee was on unauthorized leave from mid of march 2020 ie before lockdown and on 5th april he says he was on medical rest but fails to show medical documents

Good morning
This is the burning issue of today that employer is stating that he is unable to give salary due to financial crises as cancellation of new n upcoming projects due to lockdown.
But As per the Government Advisory Employer has to pay salary as side by side Govt is now providing benefits to employer in this regard also as EPF contribution etc.
Post to lock down if any Audit for this matter will be conducted by any Govt body if any company will found non following the Govt Advisory will have to face difficulty.
