Difference Between Casual Leave And Privilege Leave

Earned Leave and Privilege leave are one and the same thing. They are defined under the Factories Act. A person who has completed 240 days can become eligible for EL or PL. On the other hand, CL is governed by National Holidays and Casual Leave Act. A person is eligible for 7 CL and 7 SL per year. EL can be carried forward, but SL and CL cannot be carried forward. Please let me know how many casual leaves one can take in a month. Also, please correct me on the entitlement of EL, CL, SL as per the law in Punjab, Haryana, and Delhi.

As per my knowledge:

1. i) In Punjab, Haryana, and Himachal Pradesh Shop and Establishment Act, 18 earned leaves, 7 casual leaves (total 25), and additional 7 sick leaves are entitled to employees out of ESI, i.e., a total of 32 per annum.
ii) In Delhi, 15 earned, 12 sick, and casual leaves (total 27 leaves) for both with and without ESI.

2. Only earned leaves can be carried forward in both states: up to a maximum of 30 days in Punjab and up to 45 days in Delhi.

3. There is no rule on leave encashment as long as the employee is in employment. However, if an employee leaves the job for any reason, they are entitled to encashment of unavailed leaves up to the maximum mentioned above, at the latest salary drawn at the time of leaving.
