Accidents under ESIC - What type of accident we have to report?

I am surprised and shocked! You admit that he "suddenly fell down." Suddenly falling down itself amounts to an 'accident.' You say that there was "no injury" or "sign of injury," and still, you claim to have given him first aid treatment and then sent him to ESI. Your statements are contradictory. When there was no injury, what first aid treatment was given and why? You must immediately send an accident report in Form 16 and apologize to ESIC for the delay in sending. That will help the worker claim disablement benefit. In the absence of it, he will only be given sickness benefit. If as a result of an injury, he has any permanent injury, he can get a benefit for that too. If you do not do that, the worker has the right to go to the ESI court for his claim, and you will be in trouble.

We have no employees in ESIC coverage. I want to submit a letter to ESIC for the same. I need a format for a declaration in ESIC for this purpose. Kindly provide.

When an accident occurred, the compliances required under the following acts are as follows:

1. ESIC (Submission Form 12 under Regulation 68) to Local Office ESIC
2. Factories Act (Submission of Form 18, Notice of Accident or Dangerous Occurrence under HP Rules) under Sections 88

Is there anything else for compliance?

When I upload an accident report by mistake and have entered the wrong time of the accident, is there any way to correct that report that I have already submitted through the portal?

One of our employees has met with an accident in the company. He is not registered in ESIC. He is a new joiner, having joined just six days ago.

Is it possible to claim benefits in ESI? Please guide me.

1. Sir, please confirm whether the wages of the employee who met with an accident are within the coverable limit, i.e., up to Rs. 21,000 per month.

2. If so, your establishment should have immediately covered the said employee, allotted him an insurance number, and completed all formalities regarding the registration of the employee under the ESI Act, 1948, and the rules/regulations framed thereunder.

3. After the allotment of the insurance number to the said employee, you can submit an online accident report to the appropriate branch office of ESIC to which your unit is attached and pursue the matter with the said office. Your submission of the accident report at this stage will, however, be treated as late.

4. The employee who met with an accident may be receiving treatment from a hospital or dispensary. After the allotment of the insurance number and completion of registration formalities, he can visit and receive treatment from the ESIS dispensary as may be allotted online by the said office.

5. In case of any difficulty, I believe you can visit the appropriate branch office of ESIC and receive suitable advice/instructions on the matter.

Dear member,

I believe the employer can file any accident report as they deem proper under the provisions of the ESI Act, 1948, and the rules/regulations framed thereunder. However, whether an accident or injury is a result of or occurred during the course of employment needs to be examined by the competent officer of ESIC. I anticipate that they will inform you of their decision after reviewing the accident report and the facts of the case.

Since brain hemorrhage indicates an illness, the key aspects to consider will be the post-mortem report, the causes of death, and the medical opinion of the competent authority. Please ensure you provide complete and accurate information in the accident report and reach out to the concerned Branch Office Manager to which your unit is attached. The contents and findings in the FIR (if filed with the police authorities) may also be relevant.

Hi everyone! Ravish here. I want to ask, if the accident of an employee gets out of the company, and his family members can admit him to the private hospital, and his ESIC payment is pending for 1 month, what claim can I get? They informed HR after 48 hours. What is the right decision?
