Is Bond Legal In India...??

Many of the messages just simply say " ask the employer to go to hell ".Of course for freshers this may sound appealing.As you progress through the ladder you will have to take it serious.The law is not that simple .Bonds are enforceable in a Court of Law and Employers seek the short cut of Arbitration not Courts for enforcing it.
So we should not be easily carried away by general statements and every case of Bond will stand on its own facts.Take not it easy but seek advice before you want to break one and safeguard by preventive action.As it is said there will be loop holes in each case and look out for them. Suggesting that you should be unconcerned about it may ensure that the problem will land on your head in a big way later .

Check the wordings carefully. If it says that training cost will be recovered from you and the amount has been mentioned. then the company has a legal rights to ask for compensation from you. My advice show the contract to your lawyer before you can sign on it.

I think the other way!
From a legal perspective, if you have came to an agreement with the Company or an individual as the relevant laws suggests, i'm afraid you need to comply with it. We have Corporate examples like TCS et al for winning cases over employees for breach of contracts.
There's no room for an HR dialog in this. This should be seen and discussed from a legal perspective. And, if that favors, we defninelty can think of an Hr dimension in this.

After reading everybody view, now I am confident about that no one can stop you if you do not want continue with your current company…I mean lots of thing was wondering in my mind i.e. what will happen if I will not complete the signed duration, what will they do , my future will be in worst….So thanks a lot guys be in touch..

No worry......... employer do not have right to sign any bond from employee as per act,
Also you are not confirm employee, give the two day notice & say good byeeeeeeee

@everybody: people i am new to this community...... my name is Kaushik... i am pursuing my MBA (HR&SYSTEMS)in coimbatore.... i have a query related to this topic being discussed..... this is my first thread and i have not read the rules of this site yet... so pls excuse me if i am wrong in posting a query in the midst of the thread...

One of my friend was posted to Kolkata for her second phase training by a reputed IT company..... she had some health issues and produced medical certificates and requested for a posting were she could continue her treatment without any hindrance to her job and also to the treatment.... but they put her in Hyderabad... which made no difference... so she contacted the HR and said she will resign... the HR said that the documents will be posted to her home in a weeks time... but nothing came for 45 days.... then they sent letter asking her to pay up 65 thousand rupees......

she has not paid the amount but joined elsewhere as fresher ....
she had registered with Nascom.....
nascom has sent the following mail to her...

What should she do now regarding this mail?...... can anyone advice us as we don't want her profile to be blacklisted by nascom..... can she just update her profile and put her new employers name ? will this have any problem..... thanks in advance for your patience people.... have a nice day!!!

just one more thing... they are not excepting my resignation, so i am planing to leave the organistaion without resighning... in this case can they do anything...???
and can they create problem for me when i join another comapany.. because i have a offer in hand and i am planning to join it..
and also i have not filled NSR form for them....

There is no such law in India which allows signing of a bond of an employee with his employer. It is illegal and the employer usually gets one signed because he know that the employee is unaware about it and will serve the compnay till the bond period is over.
You can quit the job by giving them the notice period you had agreed to before joining the company.

In my office people have not only asked us to sign the bond; but also have taken our original marksheet saying they would return it back after two years only when the validity of the bond is over.
