Firstly, a few questions to ask yourself. Is this employee a permanent employee? Have you taken anything in writing while giving this amount and camera? Do you have his correct present and permanent addresses? When handing over the camera, have you issued a gate pass?

Mr. Madhu, for the very useful information. Mr. Shravan, thank you for your suggestions. Yes, he was a temporary employee, but we have written records showing that we have given him the money as well as the camera. Therefore, I will proceed with writing a warning letter to him.

Dear Ms. Brinda,

Firstly, write a formal letter addressed to both his current communication address and permanent home address as well stating that you were absent from work without authorized leave or permission (as applicable).

Secondly, state that he had carried the company's property (by description) and not returned as of the date, which is hampering other planned requirements.

Thirdly, mention that if he does not report for duty well within the stipulated date (say a week's time), then the company will be constrained to proceed further as deemed fit.

Wait and watch for his response, and if he does not respond to your mail, then report the incident to all concerned police authorities with facts and figures with a request to intervene and help you to recover the company's property (movables) he had carried away.

Meanwhile, you may also refer to his references, if any, as given in his CV and employment application and report the incident to such references too.

Please post the progress in this case. Here, you have to take action on two issues. Firstly, the recovery of Rs 70,000 plus the camera or its present replacement cost. Secondly, take action against the employee for the act of indiscipline, i.e., not reporting for duty.

The action of the abovementioned employee falls under the provisions of the Indian Penal Code. By not returning the money and digital camera, the employee has committed criminal breach of trust. If you have proper evidence, you can file an F.I.R. in the concerned Police Station and start proceedings against him. There is no legal requirement of giving any notice to him for this action.

Kindly find enclosed a show cause notice for carrying cash of the company and not reporting to duty. The company can file an FIR, but to avoid a civil case and protect our reputation, we need to wait for further search action.
