Dear all, I have one query. Can the same person work as an employee and as a consultant for the same organisation at the same time. Please suggest in any complications

Yes, it can be. That all depends on how the management accepts the scenario. Generally, companies avoid doing so. If the nature of employment is different from consultancy nature, then it can be acceptable. But both the company and the individual need to consider some points.

The establishment needs to deduct separate TDS for both cases as applicable in the law. The company should sign an agreement wherein the undertaking must be taken that as an employee, he will not use his power, link, data, etc., to benefit the consultancy scope. In case he is found guilty, then disciplinary action will be taken.

The individual needs to include both incomes while filing ITR. If the gross income increases above the Tax Deducted slab, then he has to deposit the balance Income Tax. Seniors can suggest more views.
