What you actually mean is the recognition of your Trade Union by the Management. When there is another Union in existence, and the same is recognized by the Management for the purpose of representing the workmen in the industry, there can be no compulsion on their part to recognize the new union unless it commands the majority of membership. Therefore, in the absence of any special law for Union recognition, like that of the MRTU Act in your state, the only option is to approach the Evaluation and Implementation Committee constituted by the State Government under the Code of Discipline, 1953. You should bear in mind that the recommendation of the Committee after its verification process has no statutory force, and the issue will still be a matter of the discretion of the Management.
